Terms of Service

These Terms of Service ("Terms") govern your use of the InMotus mobile application, website, and related features ("InMotus," "app," "we," "us," or "our"). By downloading, accessing, or using InMotus, you agree to these Terms. If you do not agree, do not use the app.
1. Eligibility
You must be at least 13 years old, or the age required in your jurisdiction to use the app without parental consent, to use InMotus. If you are using the app on behalf of another person, client, organization, or entity, you represent that you have authority to do so and to bind yourself or that entity to these Terms.
2. App Purpose
InMotus is a workout logging, fitness tracking, planning, coaching, and coach/client workflow app. It is intended for fitness, planning, and informational use only. InMotus is not medical advice, diagnosis, treatment, physical therapy, emergency support, or a replacement for a licensed physician or other qualified health professional.
3. Health and Safety Disclaimer
You are solely responsible for your training, exercise choices, physical condition, and use of the app. InMotus coaching, workout suggestions, progression guidance, coach-assigned workouts, human coach cues, and any recommended or displayed weights, reps, sets, rest periods, exercise changes, workout structures, or analytics are provided for general informational and educational purposes only. They are not medical advice, physical therapy advice, a guarantee of safety, or a guarantee that any exercise, load, or recommendation is safe, effective, or appropriate for you.
If you are a client receiving workouts from a coach, you remain responsible for deciding whether to perform any workout, for using appropriate weight and form, and for modifying or stopping exercise based on your own condition, ability, and judgment. If you are a coach, you are responsible for the workouts, cues, feedback, and other information you provide to clients through the app. Stop exercise and seek qualified medical advice if you experience pain, dizziness, injury, or other concerning symptoms. You voluntarily assume all risk arising from workouts, exercise decisions, coach/client interactions, and use of workout recommendations, coaching, logs, or analytics provided through the app.
4. Local-First Data and Cloud-Backed Features
InMotus is designed as a local-first app for personal workout tracking. Your local workout workspace, workouts, settings, workout photos, and related data may be stored locally on your device unless you use features that export, share, contribute, or sync data.
Some features use cloud-backed services, including anonymous community contribution, Coach & Client sync, coach account activation, push notifications, StoreKit entitlement verification, App Store Server Notifications, App Attest request signing, audit logging, and rate limiting. You are responsible for maintaining your own backups using any export tools we provide. We do not guarantee that backups, exports, imports, restores, shared workout files, cloud sync, push notifications, or remote coach/client updates will be error-free, complete, uninterrupted, compatible, uncorrupted, or recoverable.
5. Accounts and Access
Most InMotus features do not require an account. Clients can receive coach workouts without creating an account. Coach Tools require Sign in with Apple and an eligible InMotus Coach subscription. You are responsible for maintaining access to your device, Apple ID, subscription, and any coach account access you use with InMotus.
You must provide accurate information where the app requests it. You may not impersonate another person, misrepresent your role as a coach or client, attempt to access another user's coach/client data, bypass account, subscription, entitlement, or security controls, or use another person's Apple ID or device authorization without permission.
6. Coach & Client Features
Coach & Client features allow coaches and clients to connect, assign workouts, exchange workout-related information, and sync status. If you use these features:
- coaches may create invites, manage client connections, assign workouts, include coaching cues, review assigned-workout completion, view assigned-workout progress metrics, and send feedback;
- clients may import invites, accept or dismiss coach connections, receive assigned workouts, complete assigned workouts, override-start scheduled workouts, submit completion status, ratings or skipped ratings, comments, and receive coach feedback;
- assigned workout data, custom exercise or set-type data included in assignments, cues, comments, ratings, completion status, timing information, feedback, and related metrics may be visible to the connected coach and/or client as part of the feature;
- disconnecting may remove or hide active access to assigned workouts, but some coach-side history may remain available unless permanently deleted where that option is provided; and
- reconnect invites may restore continuity with the same former client where supported by the app.
If you are a coach, you are responsible for obtaining any permissions, consents, or authorizations required to enter, view, store, or process information about a client through InMotus. You are responsible for complying with laws, professional obligations, workplace policies, or contractual duties that apply to your coaching services. InMotus is a software tool and does not make you a certified trainer, healthcare provider, or professional coach.
InMotus is not a party to the coach/client relationship and does not review, verify, supervise, endorse, or control any workouts, cues, comments, feedback, recommendations, instructions, health information, progress updates, or other information exchanged between coaches and clients. To the maximum extent permitted by law, InMotus and its developers, owners, contractors, affiliates, and licensors are not responsible or liable for any information, advice, guidance, conduct, omission, dispute, injury, loss, or other harm arising from or related to coach/client communications, coaching services, or the exchange of information between a coach and client through or outside the app.
7. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use InMotus on devices you own or control, in accordance with applicable law and App Store rules. Personal features are intended for individual fitness use. Coach Tools may be used to manage clients only through the features and limits provided by InMotus and your active subscription.
8. Acceptable Use
You agree not to:
- use the app in violation of law or regulation;
- interfere with or disrupt app functionality or backend services;
- reverse engineer, decompile, or attempt to extract source code except where prohibited by law;
- bypass security, account, App Attest, StoreKit, subscription, coach/client, rate-limit, or access controls;
- use automated scripts, bots, scraping, credential stuffing, replay attacks, forged identifiers, or other abusive methods against the app or API;
- misuse exported data, barcode features, coach/client features, community contribution, push notifications, or integrations;
- submit unlawful, misleading, abusive, unsafe, infringing, or inappropriate content, workouts, cues, comments, feedback, names, or notes;
- use Coach Tools to harass, exploit, mislead, or endanger another person; or
- use the app to infringe another party's rights.
9. User Content and Data
You retain ownership of the workout logs, notes, profile information, coaching cues, client comments, feedback, and other data you enter into the app. You grant us the limited rights necessary to operate, maintain, secure, sync, provide, and improve the app and related services, including Coach & Client features, community contribution, entitlement verification, and abuse prevention where applicable.
You are responsible for the accuracy, legality, safety, and appropriateness of the data you enter or share. If you opt into anonymous community contribution, you also grant us the limited rights necessary to receive, process, aggregate, and publish those contributed metrics as anonymous community-wide statistics, subject to the Privacy Policy.
10. Premium Features, Coach Tools, Billing, and Subscriptions
Some features of InMotus require a paid purchase or subscription. InMotus Premium is intended for personal premium workout features, such as in-app coaching or advanced workout execution features. InMotus Coach is intended for managing clients remotely and includes Coach Tools, such as client invites, assigned workouts, coach cues, client progress metrics, review workflows, and feedback tools. Coach subscriptions may include Premium features, as described in the app or App Store.
If paid access is offered:
- purchases, subscriptions, renewals, cancellations, refunds, and payment processing are handled by Apple under your App Store account and Apple's applicable terms and policies;
- subscription pricing, billing period, trial terms, client limits, and renewal details will be shown in the app and/or the App Store before purchase;
- auto-renewable subscriptions continue until cancelled through your Apple account settings unless otherwise stated;
- premium or coach access may be limited, suspended, or removed if the applicable purchase is refunded, cancelled, expires, fails to renew, or is otherwise revoked by Apple;
- if a Coach subscription lapses, expires, is refunded, or is revoked, Coach Tools may be locked, active client-management features may be disabled, assigned-workout access may be limited, and remote writes may be blocked until eligibility is restored; and
- we may change which features are included in free, Premium, or Coach tiers over time, subject to applicable law, Apple rules, and these Terms.
Except where required by law or Apple policy, we do not provide direct billing, refund, or payment administration outside Apple's purchase systems for in-app purchases made through the App Store.
11. Privacy
Your use of InMotus is also governed by the InMotus Privacy Policy. Where these Terms and the Privacy Policy address the same subject, the Privacy Policy governs our data handling practices and these Terms govern app usage rights and responsibilities.
12. App Changes
We may modify, update, suspend, or discontinue all or part of InMotus at any time. We may also change these Terms. If we make material changes, we may provide notice in the app or by other reasonable means. Continued use after updated Terms take effect constitutes acceptance.
13. No Warranty
INMOTUS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE APP, COACH TOOLS, CLOUD-BACKED FEATURES, PUSH NOTIFICATIONS, ENTITLEMENT CHECKS, BACKEND SERVICES, OR COACH/CLIENT SYNC WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE FROM DATA LOSS, OR THAT ANY BACKUP, EXPORT, IMPORT, RESTORE, SHARED FILE, ASSIGNED WORKOUT, OR REMOTE UPDATE WILL BE COMPLETE, COMPATIBLE, UNCORRUPTED, OR SUCCESSFULLY RECOVERABLE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INMOTUS AND ITS DEVELOPERS, OWNERS, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, COACH/CLIENT DISPUTE, MISSED WORKOUT, MISSED NOTIFICATION, SUBSCRIPTION ACCESS ISSUE, OR REMOTE SYNC FAILURE ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INMOTUS AND ITS DEVELOPERS, OWNERS, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY CLAIM ARISING FROM OR RELATED TO WORKOUTS, PROGRAMS, CUES, COMMENTS, FEEDBACK, ADVICE, GUIDANCE, HEALTH OR FITNESS INFORMATION, PROGRESS UPDATES, OR OTHER CONTENT EXCHANGED BETWEEN A COACH AND CLIENT, WHETHER THAT EXCHANGE OCCURS THROUGH COACH & CLIENT FEATURES, THROUGH ANOTHER FEATURE OF THE APP, OR OUTSIDE THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF INMOTUS AND ITS DEVELOPERS, OWNERS, CONTRACTORS, AFFILIATES, AND LICENSORS FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM; OR (B) USD $50.
15. Indemnification
You agree to defend, indemnify, and hold harmless InMotus and its developers, owners, contractors, affiliates, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your use or misuse of the app;
- your use or misuse of Coach & Client features;
- workouts, cues, comments, ratings, feedback, profile information, client information, or other data you enter, assign, export, import, share, or otherwise use through the app;
- your breach of these Terms;
- your violation of law, professional obligation, client consent requirement, or the rights of another person or entity; or
- any coaching, training, health, safety, or client relationship dispute connected to your use of the app.
16. Termination
We may suspend or terminate your access to InMotus or specific features if you violate these Terms, if your subscription or entitlement is no longer active, or if continued access creates legal, security, abuse, fraud, operational, or safety risk. You may stop using the app at any time. Sections that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnification, ownership, privacy references, and governing law.
17. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable law requires otherwise.
